Acceptable Use Policy

PARTIES

This Agreement is between Customer and Claromentis. "Customer" is defined as the legal entity for which this agreement is being signed. If the agreement is not for a legal entity, then the "Customer" is the individual who accepts the terms.

Agreed terms

This Policy is designed to ensure the security, integrity, and stability of our Services for all customers. By using the Services, you and your Authorized Users agree to be bound by this Policy.

Any violation of this Policy may result in the suspension or termination of your account, at our sole discretion, without notice or liability.

Prohibited Activities

You and your Authorized Users may not use the Services to engage in the following prohibited activities:

1. Security and System Integrity

  • Vulnerability Scanning, Tampering, and Hacking: Probing, scanning, or testing the vulnerability of any system or network. Attempting to tamper with, disrupt, or bypass any security or authentication measures.

  • Overwhelming Infrastructure: Imposing an unreasonably large load on our systems or network infrastructure with the intent of overwhelming or disrupting them.

  • Misrepresentation: Misrepresenting yourself, your affiliation with any entity, or disguising the origin of any content (including by "spoofing," "phishing," or manipulating headers).

2. Privacy and Personal Conduct

  • Violating Privacy: Using the Services to violate the privacy of others, including collecting, storing, or disclosing their personal data without their consent or in a manner that violates applicable laws.

  • Harassment and Monitoring: Using the Services to stalk, track, or monitor others without their consent, or to harass, bully, intimidate, or post direct, specific threats or acts of violence against any individual or group.

  • Discriminatory Behavior: Engaging in, promoting, or facilitating practices that could lead to discriminatory, unfair, or harmful treatment of individuals or groups, particularly on the basis of sensitive or protected attributes such as race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or other similar status.

3. Unlawful and Unauthorized Use

  • Illegal Purpose: Using the Services in furtherance of any illegal purpose or in a manner that violates any applicable laws or regulations.

  • Unauthorized Content: Submitting content that you do not have the right to post, including content that infringes upon a third party's intellectual property or other rights (e.g., copyright, trademark, patent, trade secret, privacy rights of publicity). We will act on any notice of alleged infringement in accordance with our reporting guidelines.

4. Content Restrictions

The Services must not be used to submit, store, or transmit any content that:

  • Is false, misleading, deceptive, fraudulent, illegal, or in violation of any applicable law.

  • Is obscene, defamatory, libelous, threatening, harmful, sexually explicit (including child sexual abuse or exploitation material), indecent, harassing, or hateful.

  • Depicts or encourages serious harm or any form of violent, illegal, terrorist, tortious, fraudulent, malicious, or dangerous conduct.

  • Contains viruses, bots, worms, scripting exploits, or other similar materials intended to cause harm or disruption.

  • Is intended to be inflammatory or could otherwise cause injury, damage, or credible risk of harm to the Provider, the Services, its users, or any third party.

  • Has been previously removed for violating this policy.

5. Artificial Intelligence (AI) 

This section specifically governs the use of any Artificial Intelligence (AI) features within the Services.

  • Unlawful or Illegal Use: Using AI features to generate, promote, or facilitate any content or activity that is illegal or violates any applicable laws. This includes generating content for phishing, fraud, or cybersecurity attacks.

  • Misrepresentation and Disinformation: Generating content, including deepfakes or other synthetic media, that is designed to deceive, impersonate, or mislead others. This also includes creating or disseminating false information or propaganda.

  • Discriminatory Content: Using AI to create or disseminate content that is hateful, harassing, or discriminatory, or that perpetuates harmful stereotypes.

  • Intellectual Property and Privacy: Using AI in a manner that infringes on a third party's intellectual property rights, violates the privacy of others, or processes sensitive personal data without proper consent or security.

  • Prohibited Communication: Engaging in erotic, romantic, or sexually explicit chat with any of our AI offerings and features.

  • Efficient and Reasonable Use: Using AI features in an excessive or automated manner that bypasses normal functionality, imposes an unreasonable load on our systems, or degrades service performance for others. All AI usage is subject to the limitations set forth in the Fair Usage Policy.

6. Fair Usage Policy

This section outlines the reasonable usage limits for the Services to ensure equitable access and to maintain performance for all our customers. Usage beyond these limits may incur additional charges as outlined in your order form or be subject to service throttling or suspension.

  • Email Notifications: The Services are limited to a maximum of 10,000 email notifications per month using our third-party email service provider.

  • Storage Limit: Your storage allocation is defined in your order form. If you require additional storage, please contact your account manager for an upgrade.

  • Artificial Intelligence (AI) Services: To ensure equitable access for all users and to prevent excessive operational costs, we have implemented the following guidelines:

      • Usage: Whilst we don't currently have any limit/cap on AI usage when using our services, we reserve the right to implement a limit/cap in the future.

      • Rate Limiting and Throttling: To prevent service degradation for other users, we reserve the right to apply rate limiting or throttling to AI API calls that are deemed to be excessive or automated.

      • Abusive Patterns: We will monitor for patterns of use that indicate an attempt to bypass normal functionality, such as submitting rapid-fire, low-value queries, which may result in a temporary suspension of AI access.

 

Reporting Violations

If you become aware of any content or activity that violates this Policy, you are encouraged to report it immediately to security@claromentis.com.

Provider's Rights

The Provider reserves the right to interpret this Policy and take (or refrain from taking) action at its sole discretion. Without affecting any other available remedies, we may permanently or temporarily remove or disable access to content, or suspend or terminate a user's account or access to the Services, without notice or liability, if we determine that a user has violated this Policy. You agree to cooperate with us in any investigation into a potential violation.
